Terms and Conditions

1. Subject Matter

These Terms and Conditions govern the provision of travel organization and experience services promoted by Kua Kiala’s design, organization, and marketing of trips and experiences, applying to all relationships established between the company and the Client.

Each trip or experience is governed by a specific program, in which the respective particular conditions are detailed, constituting an integral part of these Terms and Conditions.

By proceeding with their booking, the Client declares to have known, understood, and fully accepted these Terms and Conditions, as well as the particular conditions of the chosen program.

2. Organization

Kua Kiala is responsible for the overall design and coordination of the trips and experiences presented, ensuring a careful selection of services and partners, with a view to creating distinct and high-quality experiences.

The execution of services at the destination may be ensured by local partners and independent suppliers, selected according to criteria of high standards and trust, who operate within the scope of the trip’s operation.

3. Liability

Trips are organized in accordance with the legislation applicable to the travel and tourism agency sector, and Kua Kiala’s liability is covered by Civil Liability Insurance (Fidelidade) and the Travel and Tourism Guarantee Fund of Turismo de Portugal.

4. Registration and Payments

Registration is considered valid after full payment or a 30% deposit (non-refundable) of the total service value and the proper completion of the documents sent to the client (Terms and Conditions and traveler form) within 5 days.

The remaining amount, including any additional services you request, must be paid up to 70 days before the start date of the trip.

Registrations made less than 70 days before departure require full payment upon confirmation.

Kua Kiala reserves the right to cancel registrations whose payment is not made within the defined deadlines.

5. Participant Conditions

By registering, the Client declares:

To be in adequate physical and psychological condition for the trip.
To be aware of the characteristics of the destination and the requirements of the experience.
To accept the risks associated with traveling in different contexts, including limitations in infrastructure or medical assistance.
You agree to comply with safety instructions, schedules, and ethical conduct throughout the experience. Inappropriate conduct may result in exclusion without refund.

Given the nature of the trips, the poor preparation of some countries regarding mobility, as well as the terrain in the visited locations, transportation, and hotels, it is recommended that if the traveler has any motor disability, they contact us beforehand to seek advice and understand if the trip in question has safe conditions for the traveler, or if we recommend another destination.

6. Reservations and Refusal of Participation

Kua Kiala reserves the right to refuse or terminate the participation of a Client at any time whenever it considers that their presence may compromise the safety, well-being of those involved, or the overall quality of the experience.

Kua Kiala experiences are based on principles of respect, discretion, and balance between participants, teams, and local contexts. In this sense, any behavior considered inappropriate, disruptive, or misaligned with these principles may result in immediate intervention.

If this occurs, Kua Kiala may, at its discretion:

Interrupt the Client’s participation in whole or in part of the experience;

Proceed with their removal, without any right to a refund;

Refuse future bookings whenever it deems that there is no alignment with the profile of the proposed experiences.

7. Age and Participation Conditions

Minimum age: 18 years. Minors only with legal authorization.

Participation is always subject to the suitability of the Client’s profile to the nature of the trip.

8. Program Changes and Flexibility

For operational, logistical, or external reasons, the following may occur:

Changes in schedules; Substitution of services with equivalents; Itinerary adjustments.

Whenever possible, the Client will be informed in advance. 9. Exceptional Circumstances

There are external factors that cannot be anticipated or controlled, namely political contexts, natural conditions, infrastructure limitations, or mobility restrictions.

In these situations, Kua Kiala may adapt, postpone, or cancel the experience, always prioritizing safety and operational balance.

Whenever applicable, alternatives or solutions tailored to the situation will be proposed.

9. Exceptional Circumstances

There are external factors that cannot be anticipated or controlled, namely political contexts, natural conditions, infrastructure limitations, or mobility restrictions.

In these situations, Kua Kiala may adapt, postpone, or cancel the experience, always prioritizing safety and operational balance.

Whenever applicable, alternatives or solutions adjusted to the situation will be proposed.

9. Price Changes

The prices presented reflect the costs of services at the time of the proposal, including local suppliers, transportation, and applicable exchange rates. Price adjustments may occur due to significant variations in external factors, such as operating costs, taxes, fuel, or exchange rate fluctuations.

If any changes occur, the Client will be informed transparently and promptly.

Whenever the adjustment exceeds 8% of the total value of the experience, the Client may choose to:

Confirm the price update; or
Cancel their participation, with a full refund of the amounts paid.

If the price increase is equal to or less than 8%, the Client may choose to accept the updated price or cancel the contract, which will be subject to the cancellation conditions stipulated in the general terms of the program: Up to 70 days before the trip (30% non-refundable); less than 70 days before the trip (100% non-refundable).

10. Cancellation by the Organization

Kua Kiala may cancel the trip due to:

Minimum number not reached
Exceptional circumstances

In this case, a refund of the amounts paid will be made, without entitlement to additional compensation.

11. Cancellations

Up to 70 days before: loss of deposit (30%)
Less than 70 days: total loss of the amount

Refunds are not eligible for:

Personal reasons
Lack of documentation
Medical conditions

After the trip has started, no refund will be due to the client for not using services or not enjoying programs due to force majeure or for reasons attributable to the client, even if due to negligence.

12. Refunds

There are no refunds for unused services after the start of the trip, except when not provided due to the organization’s responsibility.

13. Complaints

Complaints will only be considered if submitted:

During the trip
In writing and without delay

The Client may resort to the applicable legal dispute resolution mechanisms.

14. Documentation

The Client is responsible for:

Passport, visas, and vaccinations. Meeting destination requirements.

Kua Kiala is not responsible for entry restrictions in the destination country.

15. Travel Insurance

Travel insurance is mandatory.

The absence of insurance may lead to refusal of participation.

16. Personal Data

Client data may be shared with:

Authorities. Local partners.

Exclusively for the execution of the trip.

17. Images

Kua Kiala may capture images during trips for promotional purposes, unless otherwise indicated by the Client in writing.

18. Flights and Transportation

The purchase of flights is the Client’s responsibility, unless otherwise indicated.

Kua Kiala is not responsible for changes, cancellations, or costs associated with flights.

19. Accommodation and Meals

Accommodation and meals are defined in the program and may be subject to adjustments for operational reasons, while maintaining an equivalent standard.

20. Baggage

The Client is responsible for their baggage. Clients are advised to purchase baggage insurance and be present during loading and unloading operations throughout the trip.

21. Language

The primary language of the trips is Portuguese, and some services may be provided in English or Spanish.

22. Final Provisions

These Terms and Conditions are supplemented by the specific conditions of each travel program.
